We welcome your participation in the Hobsons Bay Community Directory. Our goal is to encourage connections between the community and community groups and help people across Hobsons Bay find and engage with groups online.

These Terms of Use (‘Terms’) govern the access and use of the Community Directory website (‘Site’). Hobsons Bay City Council (‘Council’) is responsible for the development, hosting and software maintenance of the Site. Our partner Louis Joel Arts and Community Centre (LJACC) are responsible for editing, maintaining and monitoring the site.

Definitions

Author - is the writer of any content appearing on the Site.

Authorised Representative – nominated person who administers a Group Members page.

Community members - are individuals/family groups.

Content – is any of the following (but not limited to) text, graphics, data, photographs or other materials appearing on the Site.

Council – Management of the site is by Hobsons Bay City Council (“Council”) or project partners as authorised by Council.

Group Members – are community members that join or request to join a community group page.

Site – Hobsons Bay City Council Community Directory site.

Terms – these site Terms of Use.

Acceptance of terms

By accessing or using this Site you agree to be bound by these Terms.

Council reserves the right to change these Terms at any time. We will send a notification of any change by email or via a Site notice. The most recent version of the Terms can be seen in the ‘Terms of Use’ Page.

Site changes

We reserve the right at any time, and from time to time, to modify or discontinue access to the Site (or any part), with or without notice, temporarily or permanently without liability to you. The site may undergo development or upgrade or cease to operate, and you agree that Site changes may be made without prior notice.

Registering

Community members will need to register online and agree to the Terms and the Privacy Statement to set up an account.

Community members will need to register and agree to the Terms and Privacy Statement and complete their community group details on the ‘Community Group Registration Form’ which needs to be submitted to Council. Council will verify and approve all groups to be added to the Site. The following criteria will be applied when verifying groups:

  • You must nominate an Authorised Representative to administer your group page
  • Provide your real name and contact details
  • Provide either an ABN, incorporated number, Website URL or Facebook URL in order to be verified as an official group
  • Provide an active email address

As a Community Member or Authorised Representative of a group page on the Site you must:

  • Not share your password with anyone
  • Understand that Council has the right to refuse, remove or delete an account or group page that breaches these Terms
  • Be over the age of 13 years old

If you provide any information that is untrue, inaccurate, not current or incomplete, or we suspect that you have provided such information, we may suspend or terminate your account and refuse any and all current or future use of the Site, or part of it.

User account, password and security

After you complete the user registration process, you will receive a user password and account name to access the Site. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account.

You agree to notify Council of any unauthorised use of your password or account or any other breach of security.

Site Content

You acknowledge that all posts made to this site express the views and opinions of the author, and do not represent the views and opinions of Council (except for posts by these authors). No claim is made as to the accuracy, currency and reliability of material provided on this Site.

The Council has no editorial control over or responsibility for content provided by the Authorised Representative of a group page, and any opinions, statements, products, services or other information expressed or made available by those parties. We make no representations about the accuracy or reliability of any opinion, statement or other information provided on the site by any Authorised Representative.

You agree that all information and Content, including but not limited to data, text, photographs, graphics, video, messages and other materials are the sole responsibility of the Authorised Representative of the page from whom the Content originated. You agree that consent has been obtained for any photographs, promotional material, videos or other Content posted on the Site. You will not use the name or logo of any party without having obtained the parties written consent and the use of such party’s name or logo will be subject to any conditions attaching to such consent.

You acknowledge that any Content that infringes any patent, trade mark, trade secret, copyright or other proprietary rights of any party is not permitted on the Site.

You are prohibited from commercial advertising or offering to sell or buy any goods or services, except as expressly permitted by the Council.

You agree to not post Content that contains software viruses, trojan horses, worms, time bombs, cancelbots or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

User Conduct

You agree not to use the Community Directory to engage in any activity which causes, or could be construed as causing, any form of harassment, discrimination or victimisation of another person including but not limited to:

  • race
  • religious belief or activity
  • sex
  • age
  • gender
  • disability
  • industrial association
  • lawful sexual activity/sexual orientation
  • marital, parental or carer status
  • physical features
  • political beliefs or activity
  • personal association with a person who has one of these personal characteristics

You agree not to post any abusive, obscene, misleading, malicious, discriminatory, threatening or sexually explicit material, or any other material that may violate any applicable laws.

You agree that you, as a Community Member, Group Member or the Authorised Representative of a group page, that you are solely responsible for the content of your post and Content, and all views and opinions posted are those of the author and not Council.

You agree that Council has the right to remove or edit any Content at any time that is deemed to be inappropriate without notice to you.

Right to Delete Posts

While we do not and cannot review every message posted and are not responsible for the content of these messages, we will be moderating the site and reserve the right to delete, edit or remove messages that we deem abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable. All posts on the Site must be written in English. We reserve the right to remove the posting privileges of anyone who violate these standards of behaviour at any time.

Non-commercial

The listings can be used only in a non-commercial manner. You cannot, without the express approval of Council, distribute or otherwise publish material containing any solicitation of funds, advertising or solicitation of goods or services.

Spamming

Repeatedly posting off-topic messages or "spamming" the Site by posting the same message in multiple topics or otherwise deliberately disrupting the directory is unacceptable behaviour that may result in the user's losing all directory privileges and access to the site.

We reserve the right to prohibit users who in any way violate acceptable behaviour from participating in our site.

Use and storage

You agree that we have no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Site.

From time to time Hobsons Bay City Council or its project partners will send you emails providing you with information about directory updates or training opportunities.
